These Terms of Service ("Terms") govern all services provided by SNELBIT NETWORKS SINGLE MEMBER P.C. ("SnelBit Networks", "we," "us"). By purchasing or using any service you agree to be bound by these Terms.
1 Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement. By using our services, you represent that all information you provide is accurate, current, and complete.
2 Services Provided
SNELBIT provides, among others:
- Premium shared web hosting services.
- Managed WordPress hosting services.
- VPS Hosting packages.
- Domain registration and management.
- Email hosting and related products.
- Additional services listed on snelbit.com.
We reserve the right to update, modify, or discontinue any service at any time where commercially reasonable or required by law.
3 Account Registration & Security
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- Ensuring your account and contact information remain accurate and up-to-date.
- All actions performed under your account, whether authorized by you or not.
- Promptly notifying us of any suspected or actual unauthorized use of your account.
4 Acceptable Use Policy (AUP)
You agree not to use our services for any unlawful, abusive, or prohibited purpose, including but not limited to:
- Hosting, distributing, or linking to illegal content, including content related to fraud, piracy, or explicit violence.
- Hosting adult or pornographic content — strictly prohibited on our platform.
- Engaging in spamming, phishing, malware distribution, or any activity compromising network integrity.
- Infringing upon intellectual property or privacy rights of any third party.
- Launching or participating in DoS/DDoS attacks, port scanning, or other intrusive activities.
We reserve the right to suspend or terminate any account violating this AUP without obligation to refund fees.
5 Resource Usage Limitations
- You will not use shared hosting for excessively CPU, RAM, I/O, or network-intensive activities such as cryptocurrency mining or abusive scripts.
- Each hosting plan has defined resource limits; consistently exceeding those limits may result in throttling, suspension, or a requirement to upgrade.
- We reserve the right to determine, at our reasonable discretion, whether resource usage is excessive or disruptive.
6 Payments, Billing & Automatic Renewals
- All services are billed in advance according to the billing cycle selected at checkout.
- By ordering any service, you expressly authorize us to automatically renew and charge the payment method on file for the full renewal amount.
- You are solely responsible for ensuring your payment details are accurate and have sufficient funds before each renewal date.
- Failure to pay may result in suspension and eventual termination of your services and data.
- Prices and promotions are subject to change. All renewals are final and non-refundable. Cancel before the renewal date if you do not wish to be charged again.
7 Cancellations & Refunds
- You may request cancellation at any time via your client portal or by contacting support.
- Eligibility for refunds is governed by any specific Refund Policy or guarantees stated on our website at the time of purchase.
- Setup fees, migrations, and one-time professional services may be non-refundable.
- Domain registrations, renewals, and transfers are non-refundable due to third-party registrar rules.
- Payments for service renewals (hosting, domain, email, add-ons) are strictly non-refundable.
8 Domains & DNS
- When registering or transferring a domain through SnelBit, you are responsible for ensuring registrant details are accurate and kept up-to-date.
- All domain registrations are subject to the terms of the relevant registry and ICANN rules where applicable.
- Failure to renew a domain before expiration may result in loss of ownership or additional recovery fees.
- We are not liable for loss or damage arising from your failure to renew or correctly configure domain and DNS settings.
9 Data & Backups
- We may perform regular backups as part of our platform; however, such backups are provided on a best-effort basis and are not guaranteed.
- You are strongly advised to maintain your own independent backups of all website files, databases, and email accounts.
- We are not liable for data loss arising from user error, software issues, hardware failures, cyberattacks, or events beyond our reasonable control.
10 Service Availability & Uptime
We aim to provide high service availability, and where specified in an SLA, we may target 99.9% uptime for certain hosting plans.
- Planned and emergency maintenance, hardware or network failures, and events outside our reasonable control may impact availability.
- Where an SLA applies, any remedies will typically take the form of service credits only and are not redeemable for cash or refunds.
11 Security & Abuse
- You are responsible for maintaining the security of your websites, applications, and scripts, including timely updates of CMSs, plugins, and themes.
- Any form of server abuse, hacking attempts, unauthorized access, or participation in DDoS activity will result in immediate suspension or termination.
- We reserve the right to remove or disable access to content we reasonably believe violates these Terms or applicable law.
- You agree to cooperate with us in investigating potential security incidents, abuse reports, or legal requests related to your use of our services.
12 Third-Party Services
Some features rely on third-party providers such as domain registries, SSL authorities, software vendors, analytics platforms, and payment processors.
- SnelBit Networks is not responsible for the performance, accuracy, or availability of third-party services.
- Your use of third-party services may be subject to separate terms imposed by those third parties.
13 Reseller & Third-Party Use
- If you resell or provide our services to third parties, you are responsible for ensuring your clients comply with these Terms and all applicable policies.
- Unless explicitly agreed in writing, we do not provide direct support to your end-users.
- You remain fully liable for all activities originating from the accounts of your end-users.
14 Privacy, Cookies & Tracking
Your use of our services is also governed by our Privacy Policy and Cookie Policy.
- Essential cookies are used to operate the website, client portal, and security features based on our legitimate interests.
- Non-essential analytics and marketing technologies are only activated based on your consent collected via our cookie banner.
- To the extent you process personal data of your own customers through our services, this is further governed by our Data Processing Agreement (DPA).
15 Disclaimers
Our services are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied.
We expressly disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
16 Limitation of Liability
SnelBit Networks shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from or related to the use or inability to use our services, including but not limited to loss of profits, revenue, business opportunities, or data.
To the fullest extent permitted by law, our total aggregate liability for any claim shall be limited to the amount you paid us for the affected service during the twelve (12) months immediately preceding the event giving rise to the claim.
17 Indemnification
You agree to indemnify, defend, and hold harmless SnelBit Networks, its officers, employees, contractors, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or related to:
- Your use or misuse of the services.
- Your breach of these Terms or any other applicable policy.
- Your violation of any third-party rights, including intellectual property or privacy rights.
18 Modifications to Services & Terms
We reserve the right to modify, suspend, or discontinue any part of the services at any time where commercially reasonable or required by law.
We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the services after any such changes constitutes acceptance of the revised Terms.
19 Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SNELBIT NETWORKS SINGLE MEMBER P.C. is legally established, without regard to conflict of laws principles.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
